Baseball star Trevor Bauer, who is accused by a woman of sexual assault, has lost his legal battle to have the restraining order against him lifted.

Los Angeles Superior Court Judge Dianna Gould-Saltman denied the LA Dodgers pitcher’s request for the order to be dismissed today.

The $34million-a year pitcher – dressed in a blue suit with cream shirt and maroon tie – sat before the judge at the opposite end of a long bench from his alleged victim, identified only as Ms. Hill, who was in black.

This comes after the Bauer pushed back against Ms. Hill, claiming that photos of her bruised face have been ‘edited’.

Bauer’s attorneys claimed in a court filing last Tuesday that the alleged victim is only pursuing the allegations against the 30-year-old sports star ‘to generate publicity, try to end [his] baseball career, and gain a monetary settlement.’ 

The attorneys vowed that ‘no settlements or cash offers have or will ever be made’ and said these motivations show the restraining order against Bauer should be dismissed. 

The woman, known only as Ms. Hill, claims she consented to having sex with Bauer on two occasions but, during the encounters, he allegedly punched her repeatedly, choked her unconscious and sodomized her without her consent.

The alleged victim filed and was granted a temporary restraining order against Bauer in late June and he was placed on paid leave from the Dodgers.

Bauer denies the allegations, claiming the woman willingly participated in rough sex which was ‘wholly consensual.’  

The Pasadena Police Department has launched a criminal investigation into the allegations. Bauer has not been arrested or charged with any crime in the case.   

In the court filing, seen by DailyMail.com, Bauer’s attorneys Shawn Holley and Kate Mangels argue that the restraining order should be dismissed, claiming there is no legitimate reason for it. 

They accuse the woman of pursuing Bauer for financial gain in the hopes of reaching a settlement – something they say the sports star is not open to.  

In the filing, the attorneys point to text messages from the alleged victim to a friend to support this claim. 

In a text message to a friend, they claim she wrote that ‘he[‘]s gonna try to settle with me’ and ‘offer me major cash then make me sign an nda’. 

In another message, included in the filing, the woman allegedly wrote: ‘Ill have my NDA signed and sealed, and my feelings button switched off, dont worry.

The attorneys also claim the woman was motivated by publicity and a desire to end Bauer’s career. 

They claim that, ‘despite alleging that she was fearful of the publicity [Hill] nonetheless ensured that her DVRO request got wide press.’

They claim Hill told a friend she was ‘so glad they are out’ and that ‘it is so good to have the media on my side’ when the allegations were made public.

In the filing, the attorneys also claim the accuser showed ‘repeated excitement and desire at ending [Bauer’s] baseball career.’

She allegedly told her cousin on June 15 – two weeks before filing for the restraining order – that it was ‘so hard to wait for bauer to go down,’ but ‘itll be worth it,’ according to the filing. 

Bauer’s attorneys also point to the timing of the request for the temporary restraining order as what they say is evidence that ‘undermines the credibility of her allegations.’  

The woman filed the request around six weeks after the second – and last – time she met with Bauer for sex, the attorneys claim. 

This was also allegedly around a month after their last communication via text.

Bauer’s lawyers claim this shows she ‘did not see an imminent concern about hearing from or seeing [him].’  

Last week, the woman permitted her attorney Bryan Freedman to publicly share unredacted photos of the bruises she says were caused by Bauer. 

In the photos, contained within the restraining order request, the victim’s face is seen with bruises under both eyes, and visible injuries on both her top and bottom lips. 

A partial side-profile image also shows what appear to be multiple scratches across the woman’s cheek. 

Hill also claims she had bruising on her gums and near her vagina, where Bauer punched her repeatedly. 

In Tuesday’s filing, Bauer’s attorneys cast doubt on the photos claiming they ‘appear to be edited or filtered in a manner to give a misleading or false impression of her injuries.’  

Instead, they accuse the woman of excluding and ‘deliberately mischaracteriz[ing]’ parts of her medical records in order to ‘obtain maximum media attention’. 

‘Despite CT scans showing no fractures in her head, face, and neck” Bauer’s attorneys claim, Hill ‘nonetheless stated in her affidavit that she had ‘signs of a basilar skull fracture…  when she definitively knew that her own CT scans had ruled out any fracture.’

In the documents, Bauer’s attorneys also claim the woman told Bauer she was ‘into’ their rough sex after their first encounter in April and had ‘never been more turned on in my life.’

On April 29 – a week after the first time they had sex – she allegedly sent Bauer a video of bruising, the documents claim.

Bauer ‘expressed surprise and concern, saying ‘Oh gosh. I don’t know if that was me or not but sorry if it was!’ they claim.

In response, the woman allegedly replied that she was ‘into it’. 

In another message in early May, the attorneys claim, she sent him another message saying ”pink socks’ come ‘offffff when its time to choke me out.” 

When Bauer allegedly replied asking if she wanted ‘to go out’, she replied that it ‘was a game changer’ and that she had ‘[n]ever been more turned on in my life’, the documents claim. 

DailyMail.com has reached out to the representatives and attorneys for the alleged victim for a response to the claims made in Tuesday’s court filing.  

Bauer’s attorneys filed the motion to dismiss the domestic violence restraining order ahead of a hearing in Los Angeles Superior Court hearing Monday where the two sides will argue whether the order should remain in effect. 

The hearing, which is expected to last several days, has already been pushed back several times. 

Attorneys for Bauer and the woman said during a court session last month they intend to call several witnesses, including Bauer himself.  

According to the original restraining order filing, the woman claims she had sexual encounters with Bauer in April and May and that both episodes turned violent. 

She specifically alleged that Bauer punched her in the face, vagina, and buttocks, and strangled her with her own hair until she lost consciousness.

Hill was later hospitalized for her injuries.

During one encounter, Hill claims she passed out and found Bauer sodomizing her when she regained consciousness.

‘I agreed to have consensual sex; however, I did not agree or consent to what he did next,’ Hill said in her filing. ‘I did not agree to be sexually assaulted.’

Hill said she was bleeding and struggling to walk after non-consensual anal sex, but added: ‘In my state at that time, I did not think Trevor was a threat to do anything against my will for the remainder of the night.’

The following day, Hill said, Bauer asked Hill jokingly if she was ‘feeling a little sore this morning?’

Hill said she told him that she didn’t enjoy it and said he seemed to understand.

Bauer continued to communicate with Hill over text messages and social media for the next three weeks, discussing baseball and her new job. 

Some of the conversations were of ‘a sexual nature.’ 

When the pair met again, Hill said they agreed on a safe word which she says Bauer ignored, choking her until she lost consciousness. 

When she awoke, he was punching her in the face, she claimed.

‘This was the first punch I felt but it is very possible that Trevor had already been punching and scratching the right side of my face while I was unconscious,’ she said.

‘Trevor then punched me hard with a closed fist to the left side of my jaw, the left side of my head, and both cheekbones. I remember this vividly and it was extremely startling and painful.

‘I was absolutely frozen and terrified. I could not speak or move. After punching me several times, he then flipped me back onto my stomach and began choking me with hair. I lost consciousness again.’

Hill said that she was crying and shaking after regaining consciousness and that Bauer reportedly began to console her, allegedly saying: ‘You’re safe. I’m here. You’re safe… I would never do those things to you if it wasn’t sexually.’

When she returned from Pasadena to San Diego the following day, Hill experienced severe headaches and began vomiting. 

After speaking with friends, she checked herself into a local emergency room where she told medical staff what happened to her. 

In a subsequent text message exchange included in the petition and reviewed by DailyMail.com, Hill told Bauer that doctors thought the ‘bruises/swelling’ on her face would last another week, but that she wasn’t sure when her ‘head symptoms’ would subside.

‘I just want it all to go away,’ she wrote Bauer.

‘I feel so bad that this happened,’ he responded. ‘Wish I could be there with you through it.’

‘Just grateful that you are showing that you care,’ she wrote.

‘I do. I absolutely do,’ he texted her. ‘Never want to see you hurting.’

After going to the hospital, Hill spoke to multiple San Diego Police Department detectives but said she downplayed the alleged incident as ‘rough sex’ and did not reveal Bauer’s name.

In the document, Hill explained that she spoke with Bauer by phone at the instruction of police, who were recording the call.

During that conversation, Hill said she asked Bauer: ‘What did you do to me when I was unconscious?’

In response, he allegedly admitted that he had repeatedly punched her in the buttocks. She said that he changed the topic when she said she did not consent to being punched.

Hill claimed that the call ended with Bauer acknowledging that he punched her and asking how they could move forward and if he could contact her.

‘I told him that he could because I did not know if the police still needed to collect more messages from him as evidence,’ she said. ‘It is my understanding that there is an open criminal investigation. I have not been informed whether the proper authorities intend to arrest and press charges against Trevor.

‘I intend to comply with whatever is requested of me in connection with criminal proceedings,’ she continued. ‘As the shock has worn off, I recognize the seriousness of the sexual assault I endured. I do not want Trevor to put anyone else through what I suffered.’

In one of her last messages to Bauer, Hill claims she told him the best way for him to help her would be to ‘never do this to anyone else ever again.’

‘I would never do anything to hurt anyone,’ he responded. ‘That includes you.’ 

As well as law enforcement, Major League Baseball (MLB) has also launched an investigation into the allegations.

He was first placed on seven days’ paid leave on July 2 under the joint domestic violence, sexual assault and child abuse policy adopted by MLB and the players’ union in 2015. 

Since then, the leave has been extended four times, most recently through August 13, and is likely to be extended again as the investigations continue. 

The California-born Bauer ranks among baseball’s best pitchers and won the National League Cy Young award last season as a member of the Cincinnati Reds. He last pitched on Monday, yielding two runs over six innings in a win over the San Francisco Giants.

He celebrated his impressive 2020 season by inking a three-year, $102 million contract with the Dodgers before the 2021 campaign.

Prior to his successful one-year stint with Cincinnati, Bauer pitched for the Cleveland Indians and Arizona Diamondbacks. He also played collegiately at UCLA where he set a single-season Pac-12 strikeout record.
